# AI exclusions in liability insurance: what changed

Insurers have started writing generative AI out of general liability, E&O and D&O policies. What ISO filed, what carriers have reported, what "silent AI" means, and what it means for businesses that rely on AI vendors.

## What ISO filed

Verisk’s ISO made a multistate general liability filing in July 2025, proposed effective January 1, 2026, adding "new, optional endorsements designed to address GenAI liability exposures." Trade press identifies CG 40 47 (bodily injury, property damage, and personal and advertising injury arising out of generative AI), CG 40 48 (personal and advertising injury only) and CG 35 08 (products and completed operations). Each insurer decides whether to attach them.

## What carriers have done

Insurance Journal reported in July 2026 that W. R. Berkley introduced an "absolute" AI exclusion for D&O, E&O and fiduciary liability products. Filings with state regulators show what an insurer may use, not necessarily what it attaches to every policy.

## Silent AI

Policies that neither clearly cover nor clearly exclude AI-related losses. Explicit exclusions are one way insurers are resolving it. The NAIC 2023 model bulletin on AI covers insurers’ own use of AI, not exclusions.

## What to do
